O DIREITO ECONÔMICO E A CONSTRUÇÃO INSTITUCIONAL DO DESENVOLVIMENTO DEMOCRÁTICO

Resumo

O artigo trata das funções desempenhadas pelo direito econômico na construção e modificação de instituições que estruturam e põem em funcionamento políticas democraticamente concebidas e implementadas em nome do desenvolvimento econômico. Defende, em particular, o argumento de que é possível conceber e operar o direito econômico como uma “tecnologia” para moldar arranjos institucionais legítimos e efetivos no plano das políticas públicas. Em sua interação com a economia política, o direito econômico é, a partir disso, discutido desde as perspectivas de análise, diagnóstico e aperfeiçoamento institucional. Sua especificidade está o fato dele poder ser, nessa tarefa, normativamente instrumentalizado para implementar um projeto de desenvolvimento econômico.
